As to the jury, I think that they will get it. When things are spelled out it&#039;s pretty obvious.</description>

I&#039;ve wondered about the &quot;due diligence&quot; that was performed before Caldera bought SCO.  It seems to this non-lawyer that if you expected copyrights from a seller and you didn&#039;t get them, you go after the company that sold you the bill of goods.   That would have been Caldera going after Santa Cruz Operation.  Santa Cruz Operation would then go after Novell.  I suppose the only thing SCO has in it&#039;s favor is that the copyright registrations were in Santa Cruz Operation&#039;s possession.  But when a witness says he thought copyrights were transfered, then later says patents were not transfered, because he read it in a document, and that document is the same one that says copyrights are not transfered in the line above, one begins to question the sanity of the whole proceeding.

The whole thing seemed slap dash to me, from the initial point where they begin a five billion dollar lawsuit, but didn&#039;t have their ducks lined up.  They were committing potentially millions of dollars if their target didn&#039;t roll over and buy them out.  

I don&#039;t know about you but anytime I&#039;ve had contact with a lawyer, it hasn&#039;t been cheap.  

They seem to have a shoot from the hip, fancy deal mentality that ran into a brick wall.

What concerns me is it seems to take about three years to educate someone that SCO has not a leg to stand on, yet Novell is tasked with educating a jury in fifteen days.</description>
